Terms & Conditions SERVICE SALES AGREEMENT

SUBJECT This Preliminary Information Form is intended to inform the buyer ("BUYER") who will purchase products/services from the website www.oteldenal.com regarding the distance contract to be established with OTELDENAL TURİZM TİCARET LTD. ŞTİ ("AGENCY") in accordance with the provisions of the Consumer Protection Law and the Regulation on Distance Contracts. Additionally, information regarding the matters specified in Articles 5/1 a, d, g, and h of the Regulation on Distance Contracts is included in this Preliminary Information Form.

BUYER INFORMATION Customer Name and Surname / Company Name: {{NAME}} Address: {{ADDRESS}} Phone: {{PHONE}} Email: {{EMAIL}} The identity and contact information shared by the Buyer will be used for registration and notifications, and the Buyer is responsible for notifying changes in identity and contact information or for any incorrect information provided.

The accommodation prices listed on the agency's website apply only to Turkish citizens. If the Buyer is a citizen of a country other than Turkey, a price difference may be requested. In such a case, the AGENCY will contact the BUYER through the provided contact information.

PRODUCTS/SERVICES AND PRICES SUBJECT TO THE AGREEMENT The Buyer acknowledges that additional food and beverages, personal expenses, and any goods and services outside the purchased service scope are not included in the specified prices and must be paid separately by the Buyer. In cases where the price, features, or descriptions of the purchased service are mistakenly reflected on the agency’s website due to technical or material errors, the Agency reserves the right to cancel the service and refund the collected amounts to the Buyer under Article 30 of the Turkish Code of Obligations.

PAYMENT INFORMATION The Buyer is required to pay the full service fee at the time of reservation for all reservations made through the website or mobile sales channels. Due to campaigns or similar promotions, payments may be made in one or multiple installments at different times. In such cases, the Buyer is obliged to make payments on the specified dates and amounts under the campaign terms.

If the bank or financial institution does not pay the agency the service fee for any reason, including unjust and unlawful use claims related to the Buyer's credit card, the Buyer will be liable for the service fee and all damages incurred, along with legal interest from the reservation date.

According to Law No. 7524, dated 02.08.2024, the payment and invoice must be issued in the name of the same person or institution. Payments made by a company partner, company employees, or other individuals not listed in the reservation using their personal accounts or credit cards are prohibited.

RIGHT OF WITHDRAWAL Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for the products/services covered by this contract. However, the cancellation conditions applicable to the reservation are stated below.

CANCELLATION CONDITIONS The cancellation terms for accommodation services offered to the Buyer may vary depending on the facility, accommodation period, and other conditions. The cancellation terms for the selected accommodation service are detailed on the reservation screen. The Buyer can also obtain detailed information about the cancellation terms by contacting the Agency’s call center.

The Buyer may transfer the service to a third party who meets the conditions of the service up to 7 days before the start of the service by notifying in writing or via a durable data storage medium. In the event of a transfer, the current campaigns, applications, and pricing at the time of transfer will apply, and both the transferor and the transferee will be jointly responsible for any remaining balance and all costs arising from the transfer.

If the Buyer fails to participate in the service within the specified check-in time and does not notify in writing of participation, the Agency reserves the right to cancel all reservations and services made on behalf of the Buyer after 24 hours. In such cases, no refunds will be made to the Buyer. If the Buyer notifies within 24 hours of the service start that they will participate, they may still use the service.

If a gift voucher was used in the reservation and the Buyer does not use it or partially uses it for any reason, the cancellation terms of the distance sales contract will apply. If an additional payment was made beyond the voucher value, the refund of the additional amount will be subject to these conditions. The cash refund of the voucher amount is not possible under any circumstances. If a refund is possible under the distance sales contract, the voucher will be reissued for future use within the specified period.

The Buyer cannot hold the Agency responsible for not participating in the trip due to their own faults or negligence, such as health issues or other excuses, and acknowledges that the cancellation conditions in the distance sales contract will apply in such cases.

If the Agency unjustly withdraws from providing the service, it will refund all payments made by the Buyer within 14 days. The Agency may partially or fully cancel the service before it starts if the accommodation provider informs the Agency that it will not provide the service. The Buyer can choose alternative services suggested by the Agency within the availability of the suppliers.

The Buyer has the right to:

  1. Withdraw from the contract without compensation and receive a refund of the unused service fee within 14 days,

  2. Participate in another service of equal value offered by the AGENCY without additional payment, or choose a higher-value service by paying the price difference,

  3. Select a lower-value service and receive a refund for the price difference.

If the Buyer has also purchased a transfer service, the cancellation terms of the transfer service may vary depending on the region and period. The Buyer can contact the Agency’s call center for details regarding the cancellation terms of the selected transfer service.

CANCELLATION AND REFUND PACKAGE If the Buyer has purchased the Oteldenal Reservation Cancellation and Refund Package in addition to the accommodation service, the Agency allows the Buyer to cancel the reservation without penalty. With this package, the Buyer can cancel the reservation up to 72 hours before the reservation start date.

EVIDENCE CONDITION In the resolution of any disputes arising from the distance sales contract and/or its execution, all records of the Agency, including digital records, constitute conclusive evidence.

IN CASE OF DISPUTES If the Buyer experiences any issues with the purchased product/service, they can contact the Agency’s guest relations department at 0850 811 55 33. Additionally, for reservations within the limit set by the Ministry of Commerce for the relevant year, the Buyer can apply to the Consumer Arbitration Committees or Consumer Courts.
